Our firm has been associated with several other law firms over the years to complement the other firm's legal services to its clients in the specific area of environmental law.  We generally assist other firms on sensitive projects involving complex environmental issues.  We will develop an assessment of the liability issues, options for environmental and other types of insurance to reduce the current or future liability concerns, site access, use, and/or remediation agreements which protect the client's business interests and contain liability concerns, and public relations plans as needed.  These services are coordinated  with the any other legal issues in the transactions to effectuate successful real estate property transfers, redevelopments, or other actions.  Integral in this process is control of information disclosed to any party, whether it is a news outlet, an insurance adjuster, a realtor, or any other party.  Our attorneys have had great success in this role.

We have helped clients in the following areas:

  • Co-counsel to Client's Corporate, In-House, or Real Estate Transaction Counsel on specific environmental issues related to contaminated (brownfield) real estate transactions or redevelopment projects.
  • Special counsel to Clients in formulating contamination abatement policies  and implementation plans for contaminated property.
  • Special counsel to Clients on real estate transactions to assess future liability for contaminated property and the insurance options to reduce liability and protect the clients' financial resources.
  • Legal counsel to clients conducting Phase I or Phase II property assessments during  the process of buying or selling property, to assess potential areas of contamination, likely remediation costs if such actions are necessary, measures which can be implemented to reduce contamination or mitigate its harm to humans and natural resources, and forensic analysis of the contamination to determine possible other PRPs.
