However, in certain cases, law suits are unavoidable and experienced legal counsel is essential to contain legal costs and mitigate liability. We would be happy to assist you with any of the following matters.Corporate Clients- Defense of a law suit filed by State Attorney General (for State violations) or U.S. Attorney for (federal violations). This might include a temporary restraining order, claim for natural resources damage, Superfund or CERCLA violations, or other violations. Development of a comprehensive Litigation Plan would assess potential pathways to settlement, including implementation of personnel safety and operational training programs and/or use of a Supplemental Environmental Project to offset liability, or other programs to reduce the duration of the litigation and resolve the suit to the Client's satisfaction.
- Defense of suits brought following an environmental event. These might include personal/bodily injury, business interruption, property damages, and/or private citizen suits under RCRA, or Natural Resource Damage claims for environmental contamination damage to fishing and hunting preserves.
- Analysis of any and all other parties (potentially responsible parties - PRPs) who may share some of the liability following an environmental event, in order to allocate some of the ensuing costs to these other PRPs.
- Filing of claims and/or suits against other PRPs to allocate some portion of the clean up, remediation, and legal fees following an environmental event.
Insurance Clients- Insurance defense for policy holders following an environmental claim or suit.
- Filing of reinsurance claims and/or suits for underlying environmental claims and providing legal counsel in the litigation or arbitration of those claims.
- Filing subrogation claims or suits against other parties and providing legal counsel in the litigation or resolution of those claims.
Government Clients- Provide legal counsel to County or City governments during the development of their Solid Waste Disposal Plans and Landfill Siting Ordinances.
- Provide environmental and procedural legal counsel to government bodies during Landfill Siting Application hearing process.
- Prepare suits for County or City government body contesting a Landfill Siting Application decision in a nearby community.
- Defend County or City government in a Landfill Siting Application appeal to the Illinois Pollution Control Board or the Appellate Court.
- Provide legal counsel to County or City government in response to an enforcement action or inquiry from USEPA or IEPA over the operation of a landfill or for other environmental infractions.
- Defend County or City government in suits brought by citizens/residents due to operation of a landfill and off-site contamination resulting in human health impact and/or property damage.
