  • Cost Allocation to other potentially responsible parties and cost recovery following an environmental event
  • Defense of client when government officials demand onsite access to company's site following an environmental event, for site investigation, inspection, or oversight of remediation work
  • Defense of client when government officials demand access to company's business records through the issuance of a discovery document such as a "Request for Information" inquiry or the issuance of a subpoena
  • Defense of client when government files suit against the company following an environmental event using a Notice of Violation, seeking a Temporary Restraining Order, filing suit before the Illinois Pollution Control Board, or filing some other civil or criminal action against the company under CERCLA, Clean Water Act, EPCRA, Clean Air Act, or other State's Environmental Protection Acts
  • Defense of client against third-party suit(s) following an environmental event
  • Work with County or local government to defend or prosecute Landfill Siting Application Appeals before the Illinois Pollution Control Board
  • Litigate appeals before the Appellate Court in Illinois
  • Litigate appeals in federal Courts
  • Prepare and file amicus briefs for cases before the Illinois Supreme Court or U.S. Supreme Court
  • Development of regulatory compliance programs to meet newly enacted Homeland Security, SEC, USEPA, or other agencies' rules and regulations
  • Development of a remediation or other type of compliance plan to comply with a demand from a government agency
  • Work with client's Corporate or Real Estate attorney, client's Risk Management personnel, client's government relations or public relations personnel, or other representatives to address environmental issues associated with the sale or purchase of a contaminated property
  • Assist client with development of liability analysis and assessment plan associated with a contaminated property transfer
  • Assist client with measures to reduce current and/or future liability associated with a contaminated property, including site access agreements, site contamination investigation and assessment programs, site remediation as appropriate or necessary, environmental insurance coverage needs, restricted deeds or usage covenants, and other measures to address liability concerns
